Scooter City

Scooter City's limited warranty for the all scooters is for 12 months for part and labor. Warranty begins from date of delivery and completion of the owner registration and warranty requirement form. The warranty covers manufacturer defects only. Scooter City will have no further warranty obligations under this agreement if the equipment is subject to abuse, misuse, neglect, accidents, shipping damages or if the weight capacity is exceeded.

The Warranty Does Not Cover

Normal expendable parts such as bulbs, fuses, filters, tires, brakes, etc., nor does it cover towing or transportation costs to transport the scooter to a repair facility. An engine failure due to lack of oil in the oil compartment.

To exercise this warranty

Contact Scooter City or your dealer and inform us of your defective part. Either, a replacement will be sent to you at the expense of Scooter City, or the defective part will be replaced at an authorized Scooter City dealer. Scooter City reserves the right to request the defective part to be returned to us with shipping costs at the expense of the shipper.

This warranty is void if

The warranty and registration form(s) was not returned to Scooter City or your dealer, the scooter was not checked out by a licensed professional mechanic shop prior to the initial usage, the covered components are not installed by a licensed professional mechanic, or damage to the covered component is caused by a non-covered component or a component not purchased from Scooter City.

Warranty Application

Warranty applies only to original consumer purchaser and only to products used in normal non-commercial use and service. If the total product or a part is found to be defective, Scooter City's only obligation and your exclusive remedy is the repair or replacement of the product, at Scooter City's discretion, provided that the product has not been damaged through misuse, abuse, accident, modification, alteration, neglect or mis-handling. This warranty shall not apply to any product which is found to be improperly set-up or used in any way not in accordance with the owners manual supplied with the product.
No agent, representative, dealer, distributor or employee of Scooter City has the authority to increase or alter the obligations or terms of this warranty. This warranty gives you specific legal rights and you may also have other rights, which vary from province to province. This warranty is only valid for merchandise purchased from outlets in Manitoba, Canada.

Buyer's Responsibility

Buyer agrees and understands to the nature of scooter riding and its related activities and hereby acknowledges that the buyer and riders are qualified to use and operate the motor scooter and are in proper physical condition to participate in such activity. Buyer agrees to assume all risks when allowing others to operate the buyer's scooter. If buyer is not familiar with the nature of motor scooter riding, buyer should seek professional training before operating the scooter.

Seller's Disclaimer

The seller, Scooter City makes no warranties as to merchantability or fitness for a particular purpose, either express or implied, and disclaims any responsibility for the product when used not as intended or by inappropriate or unauthorized users.

Inherent Risks

Scooter riding activities involve the risk and danger of serious bodily injury including, but not limited to disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by buyer's own actions or inaction's, the actions or inaction's of others, participating or not participating in the activity, the condition(s) in which the activity takes place or the negligence of others. There may be additional risks, including social and economic losses, either known or unknown to the buyer, not readily foreseeable, and buyer fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of buyer's participation in scooter riding activity.

Age

Buyer certifies that buyer is at least 18 years of age or the legal age of majority in the jurisdiction in which the buyer resides and jurisdiction where in this scooter will be operated. This product is not intended for the use of children under the age of 16 years old.
